Terms And Condition
- Effective Date: [EFFECTIVE DATE]
- Last Updated: [LAST UPDATED DATE]
These Terms of Use (“Terms”) govern access to and use of the Sociyaar website, mobile applications and related services (“Sociyaar” or the “Platform”).
Sociyaar is operated by [FULL LEGAL ENTITY NAME], having its registered office at [REGISTERED OFFICE ADDRESS] (“Company”, “Sociyaar”, “we”, “us” or “our”).
Sociyaar is a technology platform intended to help members of the public identify, post, discuss and bring attention to civic and community issues, including matters relating to roads, sanitation, waste, drainage, streetlights, water, public infrastructure and similar community concerns.
Users may also voluntarily indicate that they are willing to help address an issue, communicate it to appropriate authorities, volunteer their own time, provide material assistance or financially support another user or initiative.
Sociyaar itself does not undertake, guarantee, finance, supervise or take responsibility for resolving such issues.
By creating an account, accessing or using Sociyaar, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use Sociyaar.
1. Eligibility
You may use Sociyaar only if:
- 1. you are at least 18 years old;
- 2. you are competent to enter into a contract under applicable Indian law;
- 3. you are legally permitted to use the Platform; and
- 4. your account has not previously been permanently suspended or terminated by Sociyaar, unless we have expressly permitted you to create another account.
You are responsible for ensuring that information supplied when creating or maintaining your account is accurate.
Sociyaar may suspend or close an account where we reasonably believe that the user does not satisfy these requirements.
2. What Sociyaar Is
Sociyaar provides technological functionality through which users may:
- report civic or community issues;
- upload photographs, videos, descriptions and locations relating to issues;
- discuss or share issues;
- communicate with other users;
- indicate that they intend to take action regarding an issue;
- indicate that they may provide voluntary support;
- share updates concerning an issue; and
- direct attention to an issue or communicate with appropriate authorities.
Sociyaar primarily facilitates communication and the hosting, transmission and display of information supplied by users.
To the extent Sociyaar qualifies as an intermediary under the Information Technology Act, 2000, Sociyaar intends to operate in accordance with applicable intermediary due-diligence requirements and rely on protections available to intermediaries under applicable law.
Nothing in these Terms should be interpreted as a representation that protection or immunity applies where the conditions required by law have not been satisfied.
3. What Sociyaar Is Not
Sociyaar is not:
- the Government of India;
- a State Government;
- a municipal corporation, panchayat, municipality or other public authority;
- a police, fire, medical or emergency service;
- an authorised grievance portal of any government department unless expressly stated otherwise;
- an NGO or charitable organisation merely because community causes appear on the Platform;
- a contractor responsible for repairing public infrastructure;
- an employer or agency supplying workers or volunteers;
- a volunteer management organisation;
- an insurance provider;
- an engineering, legal, medical, financial or safety adviser;
- a payment gateway;
- a bank;
- a trustee;
- an escrow provider;
- a financial intermediary;
- a crowdfunding entity;
- an investment platform; or
- a fiduciary for users.
Nothing posted or displayed on Sociyaar creates an agency, partnership, employment, joint venture, fiduciary or similar relationship between Sociyaar and any user.
4. Civic Issue Reports Are User-Generated Information
Issues posted on Sociyaar are created by users.
Except where specifically stated otherwise, Sociyaar does not independently investigate or verify:
- whether an issue actually exists;
- whether photographs or videos are current;
- whether a location is accurate;
- who caused an issue;
- whether any individual, organisation or authority is responsible;
- whether an issue remains unresolved;
- whether work claimed by another user was actually performed; or
- whether an issue marked “Resolved” has in fact been resolved.
Users should independently verify information before relying upon it.
A status such as Pending, In Progress, Resolved, or any similar status is informational only and may have been selected by a user.
It does not constitute certification or confirmation by Sociyaar or by any governmental authority.
5. Sociyaar Is Not an Official Government Complaint System
Posting an issue on Sociyaar does not automatically constitute submission of a complaint, application, grievance, police report, FIR, notice, petition or service request to any government department or authority.
Posting on Sociyaar also does not:
- preserve any legal deadline;
- extend a limitation period;
- satisfy any statutory notice requirement;
- guarantee escalation to an authority;
- guarantee acknowledgement by an authority; or
- guarantee resolution of the issue.
Where an official complaint or governmental response is required, users should separately use the applicable official government or legal process.
For emergencies or situations involving an immediate risk to life, health, safety or property, users must contact the appropriate emergency service or governmental authority and must not rely on Sociyaar.
6. “I’m on It” Is a Non-Binding Expression of Intent
Sociyaar may provide features such as “I’m on it”, “Take Action”, or similar functionality.
Selecting such an option means only that the user is expressing a present intention to assist with the issue, which may include:
- informing an appropriate governmental authority;
- following up with an authority;
- helping organise lawful community action; or
- undertaking lawful assistance within the user’s abilities.
Selecting “I’m on it” does not create a legally binding promise or obligation between:
- the user and Sociyaar;
- the user and the person who created the post;
- the user and other users; or
- the user and any governmental authority.
It is not a work order, service contract, employment agreement, guarantee or representation that the issue will be resolved.
Users should not rely upon another user’s selection of “I’m on it” as a guarantee that any particular action will occur.
Unless users independently enter into a separate lawful agreement outside the functionality provided by Sociyaar, users may change or withdraw their intention.
Sociyaar does not guarantee that any user who indicates an intention to help will actually do so.
7. Volunteering Is Entirely Voluntary and at the User’s Own Risk
Any physical or other action undertaken by a user in connection with an issue identified through Sociyaar is undertaken voluntarily and at that user’s own discretion and risk.
Sociyaar does not direct, control or supervise volunteers.
Sociyaar does not:
- assign users to perform work;
- instruct users how to repair infrastructure;
- certify that a user is qualified;
- provide professional supervision;
- conduct background checks unless expressly stated;
- provide tools or equipment;
- provide safety equipment;
- provide insurance;
- provide workers’ compensation;
- provide medical coverage;
- guarantee site safety;
- obtain governmental permissions on behalf of users; or
- authorise entry upon public or private property.
A user’s ability to see an issue on Sociyaar does not give the user permission to enter property, interfere with infrastructure or perform work.
Users must obtain all permissions, approvals, licences and authorisations required by law before undertaking any activity.
Users must not undertake specialised, regulated or hazardous work unless they are lawfully authorised and appropriately qualified to do so.
This includes, where applicable, work involving:
- electricity;
- live electrical infrastructure;
- roads carrying traffic;
- potholes or road surfaces;
- public utilities;
- drainage or sewer systems;
- structural repairs;
- excavation;
- hazardous materials;
- water infrastructure; or
- any activity for which governmental approval or professional qualification is required.
Where such work is necessary, users should report the matter to the appropriate competent authority rather than attempting unauthorised repairs themselves.
To the fullest extent permitted by applicable law, Sociyaar is not responsible for any accident, injury, illness, death, property damage, legal violation, fine, penalty, dispute or other consequence resulting from activity voluntarily undertaken by users.
8. No Employment, Agency or Volunteer Relationship With Sociyaar
A user who volunteers or assists with an issue does so independently.
No user becomes an employee, worker, contractor, representative, agent or authorised volunteer of Sociyaar merely because the user:
- posts an issue;
- selects “I’m on it”;
- assists another user;
- performs community service;
- contacts a government authority;
- provides money or material; or
- participates in activity discussed on Sociyaar.
Users do not have authority to make commitments, representations or promises on behalf of Sociyaar.
Users must not represent themselves as employees, representatives or authorised agents of Sociyaar unless they have received express written authorisation from the Company.
9. “I’ll Support” Is a Non-Binding Expression of Interest
Sociyaar may provide an “I’ll Support” option or similar functionality through which a user may indicate an interest in supporting an issue through money, material, food, equipment, services, time or other lawful assistance.
Selecting “I’ll Support” is not itself a payment, donation or legally binding financial commitment.
It does not create any obligation requiring the user to contribute a particular amount or item.
Sociyaar does not guarantee that a person who selects “I’ll Support” will ultimately provide support.
10. Financial and Material Contributions Between Users
Unless Sociyaar expressly introduces a separate payment service governed by separate terms, Sociyaar does not collect, receive, possess, hold, transfer, settle, route, control or distribute users’ money.
Any financial or material contribution arranged between users is a voluntary transaction directly between those users.
Sociyaar is not a party to such a transaction.
Sociyaar does not act as:
- a trustee;
- escrow agent;
- payment aggregator;
- payment gateway;
- bank;
- lender;
- fundraising manager;
- charitable institution;
- financial adviser; or
- fiduciary.
Sociyaar does not guarantee:
- the identity of a person requesting support;
- that a stated need is genuine;
- that a requested amount is reasonable;
- that money will be spent for the stated purpose;
- that material will reach an intended beneficiary;
- that a project will be completed;
- that a contribution will be refunded; or
- that records provided by another user are accurate.
Users are responsible for independently verifying a recipient, issue and intended use before providing money or material.
Users contribute entirely at their own discretion and risk.
11. No Tax or Charitable Representation
Unless expressly stated otherwise in connection with a separate legally compliant programme, Sociyaar does not issue donation receipts or represent that contributions qualify for any tax deduction.
Sociyaar makes no representation that a user or initiative displayed on the Platform:
- is a registered charity;
- holds registration under applicable income-tax law;
- qualifies for tax-deductible contributions;
- complies with foreign-contribution requirements; or
- holds any governmental fundraising permission.
Users who request, receive or provide funds are individually responsible for complying with all tax, fundraising, foreign-contribution, anti-money-laundering and other laws that apply to them.
Users should obtain independent professional advice where necessary.
12. Prohibited Financial Activity
Sociyaar must not be used to solicit or facilitate:
- fraudulent fundraising;
- money laundering;
- financing of unlawful activities;
- investments or securities offered without lawful authority;
- contributions offered in exchange for financial return, profit or interest unless separately and lawfully authorised;
- prohibited foreign contributions;
- unlawful political or electoral fundraising;
- gambling or wagering;
- payments for illegal goods or services; or
- any transaction prohibited by applicable law.
Sociyaar may remove such content and suspend or terminate accounts involved in suspected abuse.
Where required by law, Sociyaar may cooperate with competent authorities.
13. Disputes Between Users
Any disagreement arising from:
- money provided to another user;
- material supplied;
- promises made between users;
- work performed;
- work not performed;
- quality of work;
- reimbursement;
- alleged misuse of funds;
- personal interactions; or
- offline arrangements
is principally a matter between the users involved.
Sociyaar is not required to mediate, adjudicate, reimburse or compensate either party.
Users may report suspected fraud, misconduct or violations of these Terms to Sociyaar. Sociyaar may take action concerning use of the Platform, but such action does not make Sociyaar responsible for the underlying transaction or dispute.
14. Meeting or Interacting With Other Users
Sociyaar does not guarantee the identity, intentions, qualifications or background of another user.
Users are responsible for exercising reasonable judgement when communicating, meeting, volunteering or transacting with people they encounter through Sociyaar.
Users should not assume that a person is trustworthy merely because they have a Sociyaar account, have posted an issue, have received support or have selected “I’m on it.”
Sociyaar is not responsible for conduct occurring during offline interactions between users, to the fullest extent permitted by law.
15. Account Security
You must:
- provide accurate registration information;
- maintain the confidentiality of your account credentials;
- promptly notify Sociyaar of suspected unauthorised access;
- not sell, rent or transfer your account;
- not impersonate another person; and
- use reasonable security measures to protect your account.
You are responsible for activity occurring through your account to the extent permitted by applicable law.
Sociyaar may require verification of contact details or other information where reasonably necessary for security, abuse prevention or compliance.
16. User Content
“User Content” includes information submitted, uploaded, transmitted or otherwise made available by users, including:
- posts;
- civic issue reports;
- photographs;
- videos;
- audio;
- comments;
- messages;
- descriptions;
- locations;
- status updates;
- profile information; and
- other material.
You retain ownership of intellectual property rights that you hold in your User Content.
By submitting User Content, you grant Sociyaar a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, technically modify, format, display, communicate and distribute that content as reasonably necessary to:
- operate Sociyaar;
- display the content to intended audiences;
- provide Platform functionality;
- protect the Platform and its users;
- investigate abuse;
- improve Sociyaar; and
- comply with applicable law.
The licence does not transfer ownership of your User Content to Sociyaar.
Copies may continue to exist in backups, audit records or legally required records after content is deleted for the period reasonably or legally required.
17. User Responsibility for Content
You are responsible for User Content that you submit.
Before posting content, you must ensure that:
- 1. you have the legal right to post it;
- 2. the content is not knowingly false or misleading;
- 3. photographs or videos are not deliberately presented with a false context;
- 4. you do not make allegations you know to be false;
- 5. you respect the privacy and lawful rights of other persons; and
- 6. your content complies with applicable law and these Terms.
Posting an allegation concerning another person, employee, public official, company, contractor, government body or organisation can have legal consequences.
Sociyaar does not adopt or endorse an allegation simply because the Platform permits it to be posted.
18. Prohibited Content and Conduct
You must not use Sociyaar to host, display, upload, modify, publish, transmit, store, update or share information that is prohibited under applicable Indian law, including the applicable requirements of the Information Technology Act, 2000 and rules made under it.
Without limiting the foregoing, you must not post or transmit content that:
- belongs to another person and which you have no right to use;
- is defamatory or knowingly makes false allegations;
- is obscene, pornographic, paedophilic or sexually explicit in violation of law;
- invades another person’s privacy or bodily privacy;
- unlawfully harasses or insults a person on the basis of gender;
- is unlawfully racially or ethnically objectionable;
- promotes unlawful enmity or violence;
- harms or exploits children;
- promotes or facilitates unlawful gambling or money laundering;
- infringes copyright, trademark, patent or other proprietary rights;
- knowingly or intentionally communicates misinformation or information that is patently false or misleading in violation of law;
- fraudulently presents manipulated, morphed or artificially generated content as authentic;
- impersonates another person;
- unlawfully threatens India’s sovereignty, integrity, defence, security, friendly relations with foreign states or public order;
- unlawfully incites criminal activity;
- obstructs lawful investigation;
- contains malware, viruses or harmful computer code;
- facilitates an activity prohibited by applicable law; or
- otherwise violates any law in force.
You must also not:
- post a civic issue that you know is fabricated;
- create fake accounts;
- create artificial engagement;
- threaten or intimidate another person;
- reveal another person’s private address, phone number, identity document, financial information or similar private information without lawful justification;
- misuse photographs of children or vulnerable persons;
- fraudulently solicit contributions;
- send spam;
- scrape or harvest user data without authority;
- interfere with Platform security;
- attempt unauthorised access;
- use bots or automation contrary to Sociyaar’s instructions; or
- use Sociyaar for unlawful commercial solicitation.
Sociyaar may maintain separate Community Guidelines containing additional operational rules.
19. Artificially Generated and Manipulated Content
Users must not use artificial intelligence, editing tools or other technology to create or distribute unlawful, deceptive or harmful content.
Where required by Sociyaar or applicable law, users must accurately declare that content is synthetically generated, materially altered or artificially created.
Users must not:
- falsely portray a real person as saying or doing something they did not say or do;
- generate false evidence concerning a civic issue;
- generate false government documents or electronic records;
- create deceptive synthetic representations of real-world incidents;
- remove, hide or interfere with synthetic-content labels or provenance information applied by Sociyaar; or
- use AI-generated or manipulated material in violation of applicable law.
Sociyaar may use automated systems, metadata, labels or other technical measures to identify, label, restrict or remove synthetic or manipulated information where permitted or required by law.
20. Moderation
Sociyaar may, but is not obligated by contract to users to, proactively review every item of User Content before publication.
Sociyaar may use automated tools, human review or both to identify potentially unlawful, harmful, fraudulent or non-compliant content.
Subject to applicable law, Sociyaar may at any time:
- reject content;
- remove content;
- disable access;
- add warnings or labels;
- reduce distribution or visibility;
- preserve content or associated records;
- restrict Platform functionality;
- temporarily suspend accounts;
- permanently terminate accounts; or
- take other reasonable protective measures.
Sociyaar may take these actions where we reasonably believe that:
- these Terms have been violated;
- applicable law may have been violated;
- another person’s rights may be at risk;
- the Platform is being abused;
- a user may be exposed to serious harm;
- fraud or security abuse is suspected; or
- action is required by a competent authority or court.
The exercise or non-exercise of moderation in one case does not create an obligation to take identical action in another case.
21. Compliance With Legal Orders and Intermediary Requirements
Sociyaar may remove or disable access to information and provide information or assistance where required by:
- applicable law;
- a court of competent jurisdiction;
- a legally authorised governmental authority;
- law-enforcement requirements;
- cybersecurity obligations; or
- applicable intermediary due-diligence requirements.
Sociyaar will maintain a grievance-redressal mechanism and take action within the periods required by the law applicable at the relevant time.
Where applicable law changes those periods or procedures, the legally applicable requirement will govern without requiring these Terms to be amended merely to reproduce the changed statutory period.
Sociyaar may preserve information, account information, removed content, logs and associated records for periods required or permitted by law.
22. Grievance Officer
Complaints relating to content, Platform use or matters for which a grievance mechanism is required under applicable law may be submitted to:
- Grievance Officer: [FULL NAME]
- Designation: Grievance Officer
- Company: [FULL LEGAL ENTITY NAME]
- Email: [GRIEVANCE EMAIL]
- Address: [GRIEVANCE ADDRESS]
- Telephone: [PHONE NUMBER]
The Grievance Officer will acknowledge, process and resolve complaints within the periods required by applicable law.
Users should provide sufficient information to identify the relevant account, post, content or communication and explain the basis of the complaint.
Where applicable law provides a right to approach a Grievance Appellate Committee, court, tribunal, governmental body or other statutory authority, nothing in these Terms removes that right.
23. Privacy and Personal Data
Our collection, use, retention and processing of personal data are described in our Privacy Policy.
Sociyaar will process personal data in accordance with applicable Indian data-protection law, including provisions of the Digital Personal Data Protection Act, 2023 and rules made under it to the extent they are in force and applicable from time to time.
Users should understand that content posted as Public may be viewable by other users and potentially by persons outside Sociyaar depending on Platform functionality.
Do not publish another person’s sensitive or private information merely for the purpose of reporting a civic issue where it is unnecessary to do so.
No internet-based service can guarantee absolute security, but Sociyaar will implement measures required under applicable law.
24. Public Issue Posts
Sociyaar may designate civic issue posts as Public because the purpose of those posts is to draw community attention to public or community concerns.
Before posting an issue, users should therefore assume that the post, photographs, approximate location, descriptions and updates associated with the issue may be publicly visible.
Users should avoid unnecessarily capturing or displaying:
- children’s faces;
- private residences;
- identity documents;
- licence or registration documents;
- financial information;
- personal telephone numbers; or
- other information unrelated to the civic issue.
Sociyaar may blur, restrict, remove or otherwise process such content when reasonably necessary for privacy, security or legal compliance.
25. Third-Party Services
Sociyaar may provide links to or integrations with:
- government websites;
- maps;
- payment applications;
- messaging services;
- social networks;
- external websites; or
- other third-party services.
Those services are controlled by their respective operators.
Sociyaar does not guarantee their:
- availability;
- accuracy;
- security;
- privacy practices;
- functionality; or
- performance.
Your dealings with third-party services are governed by their respective terms.
26. Sociyaar Intellectual Property
Except for User Content and third-party material, the Sociyaar Platform, including its:
- name;
- trademarks;
- logos;
- software;
- interface;
- designs;
- databases;
- features; and
- original content
belongs to or is licensed to [FULL LEGAL ENTITY NAME].
Except as permitted by law or expressly authorised by Sociyaar, users must not copy, modify, reproduce, sell, license, reverse engineer, misuse or commercially exploit Sociyaar’s intellectual property.
27. No Guarantee That Issues Will Be Resolved
Sociyaar provides technology intended to facilitate awareness and communication.
Sociyaar does not promise or guarantee that:
- an issue will receive attention;
- another user will support an issue;
- a government official will view a post;
- an authority will respond;
- funding will be received;
- volunteers will participate;
- a person offering support will perform as promised;
- an issue will be repaired;
- a proposed solution is appropriate;
- an issue marked resolved will remain resolved; or
- any particular community outcome will occur.
No such guarantee should be inferred from Platform features, status indicators, notifications, statistics or communications.
28. Platform Provided “As Is” and “As Available”
To the fullest extent permitted by applicable law, Sociyaar is provided on an “as is” and “as available” basis.
Sociyaar does not warrant that the Platform will always be:
- uninterrupted;
- error-free;
- secure;
- free of harmful components;
- accurate;
- available at a particular time; or
- compatible with every device.
Sociyaar may add, change, suspend or discontinue features from time to time.
29. Limitation of Sociyaar’s Liability
To the fullest extent permitted by applicable law, neither Sociyaar nor [FULL LEGAL ENTITY NAME], nor its directors, officers, employees or agents, will be liable for losses arising from:
- User Content;
- incorrect or misleading civic issue reports;
- reliance on information supplied by users;
- interactions between users;
- actions or omissions of users;
- volunteering;
- physical work undertaken by users;
- injury or property damage resulting from user activity;
- unauthorised activity on public or private property;
- money or material voluntarily transferred between users;
- misuse of contributions by another user;
- disputes between users;
- conduct of governmental bodies or officials;
- failure of an authority to respond;
- third-party websites or services;
- loss of Platform availability; or
- events reasonably outside Sociyaar’s control.
To the fullest extent permitted by law, Sociyaar will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss, or loss of profits, opportunities, goodwill or data.
Where Sociyaar is legally liable and that liability may lawfully be limited, Sociyaar’s aggregate liability arising out of or relating to the Platform will not exceed:
(a) the amount actually paid by that user directly to Sociyaar for use of the Platform during the twelve months preceding the event giving rise to the claim; or (b) INR 1,000, whichever is greater.
Nothing in these Terms excludes or limits any liability, statutory remedy or right that applicable Indian law does not permit the parties to exclude or limit.
30. User Indemnity
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless [FULL LEGAL ENTITY NAME], Sociyaar and their directors, officers, employees and agents from third-party claims, losses, damages, liabilities, penalties, costs and reasonable legal expenses arising from or relating to:
- User Content you submit;
- allegations made by you;
- infringement of another person’s intellectual-property rights;
- invasion of privacy;
- defamation;
- fraud or misrepresentation by you;
- unlawful fundraising by you;
- money or material requested or received by you;
- physical work undertaken by you;
- damage or injury caused by your activity;
- your unauthorised entry onto property;
- your dealings with another user;
- your breach of these Terms; or
- your violation of applicable law.
This clause does not require you to indemnify Sociyaar for liability that applicable law does not permit Sociyaar to transfer or exclude.
31. Suspension and Termination
You may stop using Sociyaar and close your account subject to Platform procedures.
Sociyaar may restrict, suspend or terminate access where reasonably necessary because of:
- violation of these Terms;
- violation of Community Guidelines;
- unlawful activity;
- fraud or abuse;
- security risk;
- repeated complaints;
- impersonation;
- risks to other users;
- government or court requirements; or
- discontinuation of the relevant service.
Sociyaar may take immediate action without prior notice where necessary for safety, security, legal compliance or prevention of serious abuse.
Where applicable law requires notice, explanation, review or another procedure, Sociyaar will comply with that requirement.
32. Effect of Account Closure
Closing an account does not automatically require deletion of information that Sociyaar is legally required or permitted to retain.
Provisions concerning:
- intellectual property;
- user responsibility;
- contributions;
- offline conduct;
- limitations of liability;
- indemnification;
- dispute-related provisions; and
- other provisions that by their nature should survive
will continue after account termination to the extent permitted by law.
33. Changes to These Terms
Sociyaar may update these Terms to reflect:
- changes to the Platform;
- new features;
- security requirements;
- operational changes; or
- changes in applicable law.
Updated Terms will be published through the Platform with an updated effective date.
Where applicable law requires additional notice, consent or communication, Sociyaar will provide it.
Continued use after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.
If you do not agree with an updated version, you should discontinue use of Sociyaar and close your account.
Sociyaar may periodically remind users of these Terms, its Privacy Policy and consequences of violating them in the manner and frequency required by applicable law.
34. No Waiver of Statutory Rights
Nothing in these Terms is intended to:
- override a mandatory provision of Indian law;
- prevent a user from approaching a court, statutory authority or tribunal where the user has a legal right to do so; or
- exclude a consumer or other statutory protection that cannot lawfully be excluded.
If a provision of these Terms conflicts with a mandatory legal requirement, the mandatory requirement will prevail to the extent of the conflict.
35. Governing Law and Jurisdiction
These Terms are governed by the laws of India.
Subject to any mandatory statutory forum or remedy that cannot lawfully be excluded, disputes relating to these Terms will be subject to the jurisdiction of the competent courts at [CITY], [STATE], India, provided those courts otherwise have jurisdiction under applicable law.
36. Severability
If any provision of these Terms is held invalid, illegal or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to operate.
37. No Waiver
Failure by Sociyaar to enforce a provision on one occasion does not constitute a waiver of that provision or any other right.
38. Assignment
Users may not transfer their rights or obligations under these Terms without Sociyaar’s prior written consent.
Sociyaar may transfer its rights and obligations to an affiliate, successor, purchaser or entity acquiring all or substantially all of the relevant business, subject to applicable law.
39. Entire Agreement
These Terms, together with the Privacy Policy, applicable Community Guidelines and any additional terms expressly applicable to a specific Sociyaar feature, constitute the agreement governing use of the Platform.
40. Language
These Terms may be made available in English and other languages.
Where legally permitted and where a translation differs from the English version, the English version will govern.
Sociyaar may provide these Terms, policies and notices in languages required by applicable Indian law.

42. Important User Acknowledgement
By using Sociyaar, you acknowledge that:
Sociyaar provides a technology platform for community communication. Sociyaar does not guarantee that a civic issue will be resolved.
Volunteering is voluntary and undertaken at the user’s own discretion and risk.
Selecting “I’m on it” does not make the user an employee, contractor, representative or agent of Sociyaar and does not constitute a guarantee that work will be performed.
Selecting “I’ll Support” does not constitute a payment or binding promise to contribute.
Any money, material, food, equipment, services or other support exchanged directly between users is at those users’ discretion and risk. Sociyaar does not hold, control, guarantee or refund such contributions unless Sociyaar expressly introduces a separately governed payment service.
Users remain responsible for complying with applicable law when posting content, contacting authorities, volunteering, raising support or undertaking activity related to a civic issue.
